BUYING A PROPERTY

The following is typical of the purchasing process in NSW:
  • Pre purchase inspections
  • Pre exchange negotiations
  • Exchange contracts/payment of deposit monies
  • Executing Loan Documentation
  • Draft transfer
  • Statutory Searches/Enquiries
  • Requisitions on title
  • Payment of Stamp duty on contract and transfer (or apply for exemption from duty for certain first home buyers)
  • Liaising with the incoming mortgagee to comply with their settlement requirements and schedule settlement.
  • Compile Settlement Adjustment Figures
  • Direct the incoming mortgagee in relation to the cheques required for settlement
  • Attend settlement in order to finalise the transaction
  • Report to the purchaser on the settlement of the transaction

SELLING A PROPERTY

The following is typical of the selling process in NSW:

  • Prepare Contract for Sale
  • Negotiate/Liaise with purchasers solicitor in relation to any requested amendments to the contract.
  • Exchange Contracts
  • Liaise with outgoing mortgagee to discharge mortgage and request payout figure
  • Respond to Requisitions on title
  • Execute transfer
  • Further liaison with the discharging mortgagee (or their solicitor) to obtain a payout figure and schedule settlement
  • Confirm Settlement Adjustment Figures
  • Direct the purchaser’s solicitor to provide the required settlement cheques
  • Attend settlement in order to finalise the transaction
  • Report to the vendor on the settlement of the transaction
